Welcome to Nokshi New York (“Nokshi,” “we,” “us,” or “our”). These Terms & Conditions govern your use of www.nokshinewyork.com (“the Site”) and your purchase of any products from Nokshi. By accessing the Site, placing an order, or using any of our services, you agree to be bound by these Terms.

If you do not agree to these Terms, please discontinue use of the Site.

GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time, including but not limited to suspected fraud, abuse, or violation of these Terms.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site or its content without express written permission from Nokshi.

ELIGIBILITY

You must be at least 18 years old (or the age of majority in your location) to purchase products from this Site. Users under 18 may browse the Site but must not make purchases.

ACCURACY OF INFORMATION

We make every effort to ensure product images, descriptions, and pricing are accurate. However:

  • Colors may vary slightly due to screen display differences.

  • Small variations may occur due to the nature of deadstock fabrics and small-batch production.

  • Measurements are approximate and may vary slightly between garments.

Such variations do not constitute defects.


ORDER ACCEPTANCE & CANCELLATION

We reserve the right to refuse or cancel an order at any time if:

  • Fraud or unauthorized activity is suspected

  • Billing or shipping information cannot be verified

  • The item is out of stock

  • Pricing or listing errors occur

  • The order violates our policies

If your order is canceled, you will be notified and refunded accordingly.

Once an order is placed, it cannot be canceled unless approved by Nokshi in writing.

PAYMENT TERMS

By placing an order, you authorize Nokshi to charge your chosen payment method for the full amount, including product cost, taxes, shipping, and applicable fees.

We accept major credit cards, Shop Pay, Apple Pay, and other forms of payment displayed at checkout.

If your payment method fails, the order will not be processed.

Chargebacks initiated for valid, delivered orders may result in account termination and further action.

PRICING & AVAILABILITY

Prices are listed in USD unless otherwise stated. Prices may change without notice.
We reserve the right to modify or discontinue products at any time.

SHIPPING

By placing an order, you acknowledge that:

  • Shipping times are estimates, not guarantees

  • Nokshi is not responsible for delays caused by carriers

  • Once the order is handed to the carrier, responsibility transfers to the customer

  • Incorrect address entries are the customer’s responsibility

INTERNATIONAL TAXES & DUTIES

International customers are responsible for all customs duties, taxes, and import fees.
These charges are not included in the purchase price and will not be reimbursed or refunded by Nokshi.

RETURNS

All returns must follow our Return Policy.
We reserve the right to refuse returns that do not meet our eligibility criteria.

  • Returns accepted within 7 days

  • Items must be unworn, unused, unwashed, with tags attached

  • Store credit only

  • $10 return processing fee

  • Customer pays return shipping

  • Original shipping is non-refundable

  • Sale and limited items are final sale

PROHIBITED USES

You may not use the Site for:

  • Illegal or fraudulent activity

  • Harassment, abuse, or harm to others

  • Uploading viruses or malicious code

  • Interference with the security or functionality of the Site

  • Data mining or scraping

Violation of these prohibitions may result in legal action.

INTELLECTUAL PROPERTY

All images, designs, written content, branding, layout, graphics, logos, and product names are the intellectual property of Nokshi New York.

We may use third-party providers (Shopify, payment processors, shipping carriers, analytics tools).
Your data may be shared as necessary to provide service.
We are not responsible for their actions, errors, or policies.

DISCLAIMER OF WARRANTIES

The Site and products are provided “as is” without warranties of any kind.
This includes:

  • merchantability

  • fitness for a particular purpose

  • non-infringement

  • uninterrupted or error-free operation

LIMITATION OF LIABILITY

To the fullest extent permitted by New York law:

Nokshi is not liable for any indirect, incidental, punitive, or consequential damages resulting from the use of our products or services, including but not limited to:

  • allergic reactions

  • misuse of garments

  • shipping delays

  • lost or stolen packages

  • website downtime

  • typographical errors

Our maximum liability is limited to the amount you paid for the product.

INDEMNIFICATION

You agree to indemnify and hold Nokshi harmless from any claims arising from your misuse of the Site, violation of these Terms, or violation of any law or third-party rights.

GOVERNING LAW (NEW YORK)

These Terms are governed by the laws of the State of New York.
Any disputes will be resolved in New York courts, and you consent to this jurisdiction.
